Please read these terms carefully
These Terms & Conditions are a legal agreement between you and To Hull and Back Media Limited and govern your use of the To Hull and Back Dating app (“THAB Dating”, the “app”, the “service”). By creating an account or using the app, you agree to these terms. If you do not agree, please do not use the service. The app is strictly for adults aged 18 and over.
1. Who we are and how to contact us
To Hull and Back Dating is a local dating service for Hull and East Yorkshire, provided by To Hull and Back Media Limited (“we”, “us”, “our”), a company registered in England and Wales. It is a sub-brand of the “To Hull & Back” brand. You can contact us at hello@hulldating.co.uk. If we need to contact you, we will use the phone number or email address you registered with, or a notice in the app.
2. Eligibility — you must be 18 or over
By using the app you confirm that:
- you are at least 18 years old;
- you have the legal capacity to enter into this agreement;
- you are not barred from using the service under the laws of England & Wales or any other applicable law, and you are not a registered sex offender;
- you have never been convicted of, or are the subject of proceedings for, a serious violent or sexual offence (we may deny access on this basis);
- you will provide accurate information and keep it up to date.
This is an adults-only service. If we find that you are under 18, or that you provided false information about your age or identity, we will suspend or delete your account immediately, and you may not create a new one.
3. Your account and verification
- You register using your mobile phone number (or email) and a one-time verification code. You are responsible for keeping access to your phone/email and account secure, and for everything that happens under your account.
- You may have only one account, and it must be for you personally — you may not create an account on behalf of anyone else or impersonate another person.
- We may offer optional “Verified Hull Local” selfie verification. A verification badge indicates a photo check has been passed; it is not a guarantee of anyone’s identity, intentions, character or safety.
- Tell us promptly at hello@hulldating.co.uk if you think someone has accessed your account without permission.
4. Acceptable use and prohibited conduct
We want THAB Dating to be a friendly, safe place for local people to meet. You agree that you will not:
- harass, bully, threaten, intimidate, stalk, defame or abuse anyone, or promote hatred or discrimination (including on the basis of race, ethnicity, religion, disability, gender, sexual orientation or gender identity);
- post, send or request nudity, sexually explicit or pornographic content, or any sexual content involving minors (which we will report to the authorities);
- post anything illegal, or that promotes illegal activity, violence, self-harm, terrorism, or the sale of drugs, weapons or other regulated goods;
- engage in commercial solicitation, prostitution, escorting, or sex work, or use the app to advertise, sell, or promote goods, services or other platforms;
- catfish or impersonate anyone, use fake, misleading, heavily edited or other people’s photos, or misrepresent who you are;
- send spam, chain messages, or bulk/automated messages, or attempt to defraud, scam, phish, or obtain money, gifts or financial information from other users (including romance scams);
- share other people’s private information without consent, or share intimate images of anyone without their consent;
- use bots, scrapers or automated means to access the app, copy other users’ data, or collect information about users;
- attempt to hack, disrupt, overload, reverse-engineer or bypass security or access controls of the service;
- upload viruses or malicious code, or do anything that could damage the service or others.
You must also comply with all applicable laws while using the app. Breaking these rules may lead to content removal, suspension or a permanent ban, and where appropriate we may report conduct to the police or other authorities.
5. Your content and the licence you give us
You keep ownership of the photos, text and other content you create and upload (“your content”). You are responsible for your content and confirm you have the right to share it and that it does not break these terms or anyone else’s rights.
To run the service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, resize, copy, display and share your content for the purpose of operating, providing and promoting the service to other users (for example, showing your profile to potential matches and delivering your chat messages). This licence ends when you delete the relevant content or your account, except that we may retain copies for a limited period as described in our Privacy Policy (for example for safety, backups or legal reasons).
We do not claim ownership of your content and we will not sell it. We may remove or refuse any content that we reasonably believe breaks these terms or the law.
6. Moderation and reporting
- You can report or block another user from within the app. Please report anyone who makes you feel unsafe or who breaks these rules.
- We review reports and may remove content, issue warnings, or suspend or ban accounts. We may use a mix of human review and automated tools, and we aim to act proportionately.
- We are not obliged to monitor all content, but we may review content to keep the community safe and to comply with our legal obligations, including under UK online safety law.
- If your content or account is removed, we will, where appropriate and lawful, tell you why and how you can appeal by contacting hello@hulldating.co.uk.
7. Safety — meeting people is at your own risk
Important safety notice
We are a platform that helps local people connect. We do not carry out criminal background checks, identity checks (beyond optional photo verification), or screening of users’ character or intentions. We cannot confirm that any user is who they say they are, or that they are safe to meet. You interact with and meet other users entirely at your own risk, and you are responsible for taking sensible precautions.
Safety tips
- Get to know someone in the app before meeting, and trust your instincts.
- Meet in a public place for the first few dates, and stay in public until you feel comfortable.
- Tell a friend or family member where you are going and who you are meeting, and arrange your own transport there and back.
- Never send money, gift cards or financial details to anyone you meet on the app.
- Don’t share your home address, workplace or other sensitive details too soon.
- Look after your drink, and don’t feel pressured to do anything you’re not comfortable with.
- Report anyone who behaves inappropriately, and contact the emergency services on 999 if you are ever in immediate danger.
8. No guarantee of matches or results
We provide the tools to help you meet people, but we cannot and do not guarantee that you will get any matches, messages, dates, or a relationship, or that other users are active, genuine, compatible or suitable. The service is provided on an “as is” and “as available” basis. We may change, add or remove features, or set limits (for example on likes or messages), to run the service.
9. Premium subscriptions, payments, cancellation and refunds
We may offer paid “Premium” features. Where we do, the following applies (in addition to any pricing and details shown at the point of purchase):
- Payments are processed securely by Stripe. Prices are shown before you buy and include VAT where applicable.
- Subscriptions renew automatically at the end of each billing period at the then-current price, unless you cancel before the renewal date. We will make renewal terms clear before you subscribe.
- You can cancel the auto-renewal at any time from your account settings or by contacting hello@hulldating.co.uk. Cancelling stops future renewals; you keep access until the end of the period you have already paid for.
- Refunds — our general policy: Premium gives you access to digital features immediately once you subscribe. For that reason, subscription payments are non-refundable once your subscription has started, including for any unused portion of a billing period. Cancelling stops future renewals but does not refund the period you are already in. This does not affect your statutory rights (see below).
- 14-day cooling-off: as a consumer buying digital content at a distance, you normally have 14 days to change your mind under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Because Premium is digital content supplied instantly, when you subscribe you ask us to start straight away and you agree that you lose this 14-day cancellation right once the service has begun.
- Good-faith exceptions: even though payments are non-refundable, we want to be fair. We will consider a refund, at our reasonable discretion, if:
- you were charged in error or charged twice for the same period;
- you were charged after cancelling, or your renewal went through despite a cancellation request we received in time;
- a technical fault on our side stopped you using the Premium features you paid for and we were unable to put it right promptly; or
- you subscribed by genuine accident and tell us quickly, before you have made real use of the Premium features.
- Your statutory rights are unaffected. Nothing here limits your rights under the Consumer Rights Act 2015. If a paid feature is faulty or not as described, you may be entitled to a repair, replacement or refund regardless of the above.
- Purchases through an app store: if you ever buy Premium through Apple or Google rather than directly on our website, that purchase and any refund are handled under that store’s own terms and refund process, not by us.
- We may change subscription prices, but we will give you reasonable advance notice and the new price will only apply from your next renewal.
10. Suspension and termination
- You can stop using the app and delete your account at any time from Settings.
- We may suspend, restrict or permanently terminate your account, with or without notice, if you break these terms, if we reasonably believe your conduct puts other users or the service at risk, if you provide false information, or where we are required to by law.
- If we terminate your account for a serious breach, you may not be entitled to a refund of any unused subscription, to the extent the law allows. If we close the service entirely, we will give reasonable notice and a fair refund of any pre-paid, unused Premium.
- Some provisions naturally survive termination (including content licence tails, liability limits, indemnity, and governing law).
11. Our liability to you
Nothing in these terms limits or excludes our liability where it would be unlawful to do so — this includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited under English law or that would affect your statutory rights as a consumer.
Subject to that, and to the fullest extent permitted by law:
- we are not responsible for the conduct of other users, whether online or offline, or for any content they post, or for any loss, harm, injury or distress arising from your interactions or meetings with them;
- we are not liable for indirect or consequential losses, or for loss of profit, data, goodwill or opportunity;
- we are not liable for any failure or delay caused by events outside our reasonable control, or for interruptions, bugs, or unavailability of the service;
- where we are liable to you, our total liability arising out of or in connection with the service is limited to the greater of (a) the total amount you paid us in the 12 months before the event giving rise to the claim, or (b) £100.
We provide the service for personal, private use. If you use it for any commercial purpose we will have no liability to you for any business losses.
12. Your promise to cover our losses (indemnity)
To the extent permitted by law, you agree to reimburse us for any reasonable losses, costs and claims we suffer that are caused by your breach of these terms, your misuse of the service, your content, or your unlawful conduct towards another user or third party. This does not apply to the extent the loss was caused by us.
13. Intellectual property
The app, its name, branding (including “To Hull and Back” and “THAB Dating”), design, text and software are owned by us or our licensors and are protected by law. You may use the app only as allowed by these terms and may not copy, modify, distribute or create derivative works from it without our permission.
14. Changes to these terms and to the service
We may update these terms from time to time — for example to reflect new features, or changes in the law. If a change is significant, we will take reasonable steps to tell you (for example a notice in the app) before it takes effect. The “Last updated” date shows when they were last revised. If you continue to use the app after a change, you accept the updated terms. If you do not accept them, you should stop using the app and may close your account.
15. Privacy
Our Privacy Policy explains how we collect and use your personal data, and forms part of your agreement with us.
16. General
- If any part of these terms is found to be unenforceable, the rest will continue to apply.
- If we do not enforce a right straight away, that does not mean we have waived it.
- You may not transfer your rights under these terms to anyone else. We may transfer our rights and obligations to another organisation, and we will tell you if we do; this will not affect your rights.
- These terms are the entire agreement between you and us about the service.
17. Governing law and complaints
These terms, and any dispute arising out of or in connection with them or the service, are governed by the laws of England & Wales, and the courts of England & Wales will have jurisdiction — although if you live in another part of the UK, you may also be able to bring a claim in your local courts.
If you have a problem, please contact us first at hello@hulldating.co.uk so we can try to sort it out. We aim to respond promptly and resolve complaints fairly.
18. Acceptable Use Policy
This Acceptable Use Policy (“AUP”) forms part of these Terms and expands on section 4. It sets out what you may and may not do on the app. Breaking it can lead to content removal, suspension, a permanent ban and, where appropriate, a report to the police or other authorities.
You must be 18 or over.
The app is strictly for adults aged 18+. You must use your real identity and your own genuine photos, one account per person. We verify age and identity signals at sign-up and on an ongoing basis, and remove accounts we believe to be under 18 or fake.
Zero tolerance for content involving minors.
Any sexual content involving a person under 18, any sexualisation of minors, or any attempt to contact, groom or meet a child is absolutely forbidden. We remove it immediately, ban the account, preserve the evidence and report it to the police and the relevant child-protection authorities (in the UK, this includes referral routes such as the Internet Watch Foundation and the National Crime Agency / CEOP).
Prohibited content and conduct. You must not use the app to create, upload, send, request, promote or arrange:
- Adult or sexual services for payment — including prostitution, escorting, pay-per-view or paid live-chat/webcam services, sexual massage, fetish services, “sugar” arrangements, mail-order-bride services, or the promotion of paid adult content (e.g. OnlyFans) or any exchange of sexual acts or content for money or goods.
- Pornography or sexually explicit material, nudity, or unsolicited sexual images or messages.
- Non-consensual intimate images or the sharing of any sexual image of a person without their consent (“revenge porn”).
- Human trafficking, modern slavery or sexual exploitation of any kind.
- Harassment, bullying, threats, stalking or intimidation, on or off the app.
- Hate speech attacking people based on race, ethnicity, nationality, religion, disability, sex, gender identity, sexual orientation or age.
- Violence or extremism — threats of violence, or content promoting terrorism, extremism or self-harm.
- Fraud, scams and financial exploitation — romance scams, catfishing, phishing, investment or “pig-butchering” schemes, fake giveaways, or requests for money, gift cards, crypto or bank/card details.
- Illegal goods or activity — drugs, weapons, stolen or counterfeit goods, or any unlawful goods or services; and money laundering or any attempt to use the app or its payments to move or disguise criminal funds.
- Spam and off-platform funnelling, impersonation, sharing others’ private information (“doxxing”), or bots, scraping, hacking or attempts to bypass our safety or security systems.
Payments.
Payments on the app are for Premium app features only. You must not use the app or its payment features for any prohibited activity above, to launder money, to take payment for sexual services or adult content, or to make dishonest chargebacks. We work with our payment provider to detect and prevent misuse and will decline, reverse or report suspicious transactions.
Moderation, reporting and complaints.
Every profile and message can be reported in-app, and automated safety filters flag prohibited content for human review. You can also email hello@hulldating.co.uk. We review reports, keep moderation records, and—depending on severity—remove content, warn, restrict, suspend or permanently ban accounts, and refuse re-registration. If you are unhappy with a decision, contact us at the same address and we will look into it fairly. Serious or illegal conduct is reported to the authorities as set out in section 19.
19. Law Enforcement Guidelines
These guidelines explain how UK police and other authorised public authorities can request information from To Hull and Back Media Limited. We assist lawful investigations while protecting our users’ rights under UK data protection law. Nothing here waives any legal objection or any user’s rights.
- How to contact us: email hello@hulldating.co.uk with “Law Enforcement Request” in the subject. Requests should come from an official email address or on headed paper and identify the officer, force/agency and a callback contact.
- Legal process we require: we disclose user data only where legally required or permitted — for example under a court order, production order or warrant valid under the law of England and Wales, or a valid request meeting the Data Protection Act 2018 (including disclosures for the prevention or detection of crime). Overseas requests should come via a UK authority or applicable MLAT.
- Emergency requests (risk to life): where there is an imminent risk of death or serious physical harm, we can review an emergency disclosure request without a court order. Email us with “EMERGENCY — Law Enforcement” in the subject, describing the danger, the account(s) involved and the information needed.
- Preservation: we can preserve relevant account records for a reasonable period while you obtain the correct legal process.
- What we may hold: sign-up name, email and mobile number; profile details and photos; sign-up and last-active dates; IP address and device/session data; records that a message was sent (and, where retained, its content); reports and safety flags; and payment records held by our payment provider (we do not store full card numbers). We keep data only as long as needed under our Privacy Policy, so some data may no longer be available.
- Members of the public: to report someone, use the in-app report button or email us. If someone is in immediate danger, always call 999.
20. Business advertising (Perks & listings)
This section applies to businesses that advertise with us — Perks directory listings, swipe-deck slots, date-spot placements and any related promotion. By submitting a listing or making a payment you (the advertiser) agree to these terms.
- Your content & rights: you confirm the business details, logo, images, offer and any other material you give us are accurate, lawful, not misleading, and that you own or have the right to use them. You grant us a licence to display them across the app, our website and our member communications while your listing is active.
- We review everything: nothing goes live until we approve it. We may reject, edit, pause or remove any listing or offer at our reasonable discretion — for example if it is inaccurate, unlawful, unsafe, off-brand or the subject of complaints — without notice.
- Member offers: any discount or perk you advertise must be genuine, clearly described and honoured for members for the period stated. Disputes about an offer are between you and the member; we are not a party to it.
- Payments: monthly listings are a recurring subscription that renews until cancelled. Swipe-deck slots are prepaid one-off bookings for the month(s) chosen; a booking for the current month is charged pro-rata for the days remaining. Prices are shown before you pay and include any stated discount.
- Refunds: advertising fees are non-refundable once a listing is live or a slot is booked, except at our reasonable discretion (handled case by case). If we remove your listing for breach of these terms, no refund is due.
- No guaranteed results: we do not guarantee any level of views, taps, saves, visits, leads, sales or matches. Placement, frequency and audience may change as the app evolves.
- Availability & changes: the advertising service is provided “as is”. We may change features, placements, pricing (with reasonable notice for renewals) or withdraw the service.
- Liability & indemnity: our liability to advertisers is limited as set out in sections 11–12, and we have no liability for your business losses. You agree to cover us against claims arising from your listing, offer or content.
- Cancellation: you can cancel a monthly listing any time from your business account or by emailing hello@hulldating.co.uk; it stops future renewals and your listing ends at the close of the paid period.
By using To Hull and Back Dating you confirm that you are 18 or over and that you accept these Terms & Conditions, our Acceptable Use Policy (section 18) and our Privacy Policy.
